Terms and Conditions of eeebid.com Inc. and subsidiaries for Online Bidding / Request For Quote Services

Definitions

1. Organizer or Buyer: is a person that represents a private entity, a legal entity or an economic organization without legal entity and who conducts the auction / request for quote.

2. Bidder or Supplier: is a person that represents a private entity, a legal entity or an economic organization without legal entity and who is invited to the auction / request for quote process, by the Buyer. The Bidder is accepting the conditions of the Organizer. The Bidder takes full liability, that he is empowered to sign contracts for the entity he is representing.

3. Guest: is a person that represents a private entity, a legal entity or an economic organization without legal entity, that is invited to the auction / request for quote process and has only view rights of the Organizer, but altering rights of the tender.

4. Provider: is eeebid.com Inc. and legal subsidiaries eeebid KFT., S.C. eeebid SRL or eeebid.com Inc. o.s..

5. Users: is common group of the Organizers, the Guests and the Bidders.

6. Parties: is common group of the Organizers, the Guests, the Bidders and eeebid.com Inc. and legal subsidiaries.

§ 1 Parties accept, that reading, understanding and accepting of this present Terms and Conditions is their own responsibility at any time entering to the internet sites of www.eeebid.com.

§ 2 Bidder confirms, that he is conscious about the information displayed by the Organizer on the Conditions page and of the uploaded documents on the Documents page.

§ 3 Bidder agrees, that every bid or quote placed through the internet site www.eeebid.com is legally binding without further confirmation for 30 days, if not other mentioned in the tender by the Organizer.

§ 4 Bidder agrees, that Organizer conducting any auction / request for quote on www.eeebid.com are not obliged to award the contract(s) under negotiation, to the best or any of the Bidders.

§ 5 eeebid.com Inc. and its legal subsidiaries are just working as agents between Organizer and Bidders, offering contracts. eeebid.com Inc. and its legal subsidiaries strictly underline that they take no liability whatsoever for either Bidders nor Organizer offering contracts fulfilling their obligations.

§ 6 No information or code obtained from the internet sites of eeebid.com Inc. may be stored beyond the browser, distributed or resold without prior written consent of eeebid.com Inc. or its legal subsidiaries.

§ 7 All data stored by any of the Users of the internet sites of eeebid.com Inc. is taken with care and secrecy by Provider.

§ 8 Bidder agrees, not to give out any data to any third party;  to take care and secrecy to all data gained by the auction / request for quote process, before, during or after the bidding process. Bidders’ own offers are exceptional.

§ 9 Parties accept, that in case of any trial of entering their computing system of any incompetent agent (hacker, cracker) let Provider know about as soon as they realize the event. Any harm caused by the hacker is taken as ‘vis majority’ by all Parties.

§ 10 Users accept that all data recorded at the registration required for identification for entering to the electronic marketplace are stored in the Companies Directory and Database of Provider.

§ 11 US law applies to any legal disputes between eeebid.com Inc. and Buyers and their Bidders. Default court is the district court of Dover in Delaware, USA.
For Hungarian Organizations and Hungarian Bidders the Hungarian Law applies to any disputes.

§ 12 Parties accept to be full liable to the aggrieved party by violating any of these paragraphs of this present Terms and Conditions.

§ 13 Should any of the paragraphs mentioned above be incorrect or become incorrect over time, then the remaining terms of contract still rest binding and the paragraph in question should be reinterpreted in a way conforming to the original intentions of eeebid.com Inc.
